CA01 | What material does Canada need for the work, the chain of rights and the alleged copying?

Sections 3, 13 and 27 of the Copyright Act provide the framework for exclusive rights, ownership and infringement. Preserve the specific version, a substantial-part comparison, and employment, commission and assignment material. Being the author does not by itself stand in for the chain of rights.

Applies when: The court, the applicable law, the date of the act, ownership of the rights and the facts of the case all have to be confirmed.

Exceptions and defences: The scope of protection, licences and statutory exceptions each have to be examined separately.

CA02 | How should Canadian exceptions be recorded?

Fair dealing under ss.29–29.2 is built on enumerated purposes and their conditions. The United States four-factor provision cannot be copied across as Canadian law. Collect the purpose of use, the context, licences and market facts, without pre-judging a conclusion about AI training.

Applies when: The court, the applicable law, the date of the act, ownership of the rights and the facts of the case all have to be confirmed.

Exceptions and defences: The courts' fair dealing analysis, other exceptions and any later reform have to be checked separately.

CA03 | How is the authenticity of electronic material preserved?

In proceedings governed by the Canada Evidence Act, s.31.1 concerns authenticity and s.31.2 and following concern system integrity and the best evidence rule. s.31.7 preserves other rules of admissibility, and provincial procedure cannot be applied mechanically.

Applies when: First check whether the proceeding is governed by the federal Evidence Act and whether separate provincial rules apply.
