MX01 | Should an unregistered Mexican work be excluded?

Article 5 of the LFDA states that protection arises on fixation and does not depend on registration or any other formality; Articles 3, 13 and 27 still have to be examined for the work and the specific rights. Collect the work and contracts that exist — do not require a registration fee to be paid before someone can join.

Applies when: The court, the applicable law, the date of the act, ownership of the rights and the facts of the case all have to be confirmed.

Exceptions and defences: The scope of protection, licences and statutory exceptions each have to be examined separately.

MX02 | Can Mexican exceptions be applied directly to other countries?

Article 148 of the LFDA lists specific uses and their conditions. Research should preserve the actual use, licences, sources and corresponding content, and must not treat US fair use or an EU opt-out as Mexican law.

Applies when: The court, the applicable law, the date of the act, ownership of the rights and the facts of the case all have to be confirmed.

Exceptions and defences: The preconditions for Article 148, the specific situations and other rules require a specific examination.

MX03 | Which electronic evidence procedure applies in Mexico?

Transitional articles two to four of the CNPCF require the federal and state implementation declarations, the implementation date and matters already under way to be checked. The old CFPC is marked as repealed on the official page and cannot be treated as the national default procedure for 2026.

MX04 | Under the new procedure, how are documents and playback tools prepared?

Article 335 of the CNPCF allows relevant scientific and technical material and deals with providing the means to reproduce it; Articles 349–350 concern the reliability of the method, attributability, subsequent accessibility and integrity. Formal use still requires the old-versus-new procedure question to be settled first.

Applies when: First confirm that the CNPCF is already in force for that court and that proceeding.
